Privacy Policy of Dental School – TMCS, LDA

1. SCOPE AND OBJECT OF THE GENERAL CONDITIONS OF DENTAL SCHOOL, TMCS, LDA

These General Conditions are intended, along with the registration form and other elements mentioned on this site, to regulate the terms and conditions under which the Service of DENTAL SCHOOL, TMCS, LDA, headquartered at Rua do Paraíso, 184-3º Esqº Frente 4000 – 375 PORTO, under the unique registration and corporate identification number 513 173 790, hereinafter referred to as DENTAL SCHOOL, TMCS, LDA, will be provided.

The Service consists of making available, through the address www.dentalschool.pt, information related to the company and a set of products and/or services, allowing the User to electronically register for the courses advertised therein, under the terms and conditions described here.

The elements and information transmitted by the User will have full legal effects, acknowledging that the User’s electronic acquisitions cannot claim a lack of signature for non-fulfillment of the obligations assumed.

2. SERVICE INFORMATION

This information applies to Training Actions developed in person or at a distance promoted by DENTAL SCHOOL, TMCS, LDA, thus covering Trainees and Trainers under the Rules of the Training Operating Regulations.

3. PAYMENT

At the time of registration, the trainee must make the full payment for the course or the first installment if opting for phased payment. The remaining amount will be paid by the trainee during the course, until the end, according to the commitment made upon signing the registration form with DENTAL SCHOOL, TMCS, LDA.

The course fee includes attendance at the training action as advertised and the Training Regulations, as well as access to course documentation and the issuance of Certificates in paper or digital format (as per the Certificate issued via SIGO).

4. RIGHT OF WITHDRAWAL

The Trainee has the right to cancel their registration or attendance in the course. DENTAL SCHOOL, TMCS, LDA reserves the right to refund the amount paid, as disclosed on this site and provided in the Training Regulations and/or Training Contract, signed by both parties.

5. WITHDRAWAL

Withdrawal from a course is also governed by the same conditions mentioned in the previous item.

6. CANCELLATION

Failure to pay the registration or course fee, in whole or in part, will result in cancellation without the right to any reimbursement.

7. CONDITIONS FOR TRAINING OPERATION

7.1. Courses are conducted in person or online, on the Moodle e-learning platform. DENTAL SCHOOL, TMCS, LDA will ensure its proper functioning, maintenance, and support. Access data for the platform will be sent to the trainee prior to the start of the respective course, along with usage instructions, after full payment has been received.

7.2. The trainee has the right to attend the course according to the objectives, program, and schedule established for the respective course. It is their responsibility to have the necessary computer equipment or other required tools, being informed of this in advance.

7.3. The trainee has the duty to ensure the truthfulness of the declarations made during registration as well as to provide DENTAL SCHOOL, TMCS, LDA with any additional documentation requested.

7.4. In e-learning courses, the trainee will have a course schedule available on the platform. The schedule will include the start, development, and end dates of the course. The mandatory attendance for the respective course is detailed on this site and in the Training Regulations published by DENTAL SCHOOL, TMCS, LDA.

7.5. Once the e-learning course has started, the trainee will have access to it 24 hours a day until its completion.

7.6. During the e-learning course period, it is the trainee’s duty to attend, ensuring their presence in synchronous and asynchronous sessions, as well as completing assignments and assessment tests and participating online in activities proposed by the trainers.

7.7. While attending the e-learning course, the trainee is entitled to tutorship provided by a duly accredited trainer, which can be conducted via email or pre-scheduled synchronous sessions. Tutorship does not include the discussion or analysis of issues beyond the course topics, nor consultancy.

7.8. The assessment of trainees depends on the specifics of each course. Information about the type of assessment will be included in the course schedule.

7.9. There will also be an evaluation of the course and the respective trainer, which will be conducted through specific questionnaires to be completed by the trainee at the end of the course/modules.

8. CERTIFICATION

At the end of the training, trainees are entitled to a Training Certificate if they have achieved a minimum attendance of 95%.

Our training certificates are issued through the SIGO platform (Information and Management System for Educational and Training Offers) coordinated by GEPE-Ministry of Education and Science, as provided in Ordinance No. 474/2010.

Because we aim for excellence and prestige in training, at the end of long-term courses (over 150 hours), we will also award our students who achieve a rating of “Very Good” or “Excellent” a diploma of merit.

9. INTELLECTUAL PROPERTY

The educational content provided may only be used for its intended purpose of teaching/learning, and it is strictly prohibited for the trainee or any other user of this site to use the educational material for commercial purposes, refraining from engaging in any acts that may violate the law or copyright and related rights, such as reproduction, marketing, transmission, or making such content available to the public, or any other unauthorized acts concerning the same content.

10. GDPR – General Data Protection Regulation

At DENTAL SCHOOL, TMCS, LDA, the privacy and protection of personal data of its clients and other data subjects are fundamental.

DENTAL SCHOOL, TMCS, LDA, as a duly certified training institution, only collects and processes your personal data that are strictly necessary to comply with legal and regulatory obligations, in the context of activities associated with the following services:

  • Conducting training courses
  • Conducting internships complementary to training or professional ones, after the same.
  • When you have given your prior and express consent.

WHO IS RESPONSIBLE FOR YOUR PERSONAL DATA?
DENTAL SCHOOL, TMCS, LDA, with corporate number 513 173 790, is responsible for processing your personal data.

WHAT CATEGORIES OF DATA DO WE PROCESS?

  • Demographic data (e.g., name, gender, place of birth, date of birth, nationality);
  • Contractual data (e.g., account number, IBAN);
  • Contact data (e.g., address, phone number, email address);
  • Governmental data (e.g., citizen card number, taxpayer number, passport number).

REASONS WE PROCESS YOUR DATA AND IN WHAT SITUATIONS

DENTAL SCHOOL, TMCS, LDA only processes your personal data in the following situations:

  1. FOR THE EXECUTION OF A CONTRACT ENTERED INTO WITH YOU.
    Includes: data processing necessary for conducting a training course; data processing for carrying out a curricular internship; management of the contractual and commercial relationship.

  2. TO COMPLY WITH LEGAL OBLIGATIONS TO WHICH DENTAL SCHOOL, TMCS, LDA IS SUBJECT.
    Includes: data processing for issuing all types of accounting documents, or managing processes in litigation.

  3. TO SATISFY THE LEGITIMATE INTERESTS OF DENTAL SCHOOL, TMCS, LDA.
    Includes: telephone or email contact to complete course registration when the registration process is incomplete; monitoring of trainees throughout the course; recovery of outstanding amounts.

  4. WHEN YOU HAVE GIVEN YOUR PRIOR AND EXPRESS CONSENT.
    Includes: promotion of services suited to the client profile; providing personal data (Name, address, phone, and email) to Internship Institutions exclusively for organizing internships in an external institution.

DENTAL SCHOOL TMCS Lda only retains and processes your personal data for the purposes outlined above for as long as necessary to fulfill those purposes, applying appropriate information retention criteria for each processing in line with applicable legal and regulatory obligations.

Regarding the processing of your personal data, the client enjoys the following rights:

  1. RIGHT OF ACCESS
    Whenever requested, you can obtain confirmation on whether your personal data is processed by DENTAL SCHOOL TMCS Lda. You may also access your personal data and obtain the following information:
    1.1. Reasons why your personal data is processed;
    1.2. Categories of personal data being processed;
    1.3. Entities to whom your personal data may be disclosed, including entities located in countries inside or outside the European Union or international organizations, in which case you will be informed of the guarantees applied to the transfer of such data;
    1.4. Retention period of your data or, if that is not possible, the criteria for determining that period;
    1.5. Rights you have concerning the processing of your personal data;
    1.6. If the personal data were not provided by you, information about the source of such data.

  2. RIGHT TO RECTIFICATION
    Whenever you consider that your personal data (provided by you or not) is incomplete or incorrect, you can request its rectification or completion.

  3. RIGHT TO ERASURE
    DENTAL SCHOOL, TMCS, LDA is subject to numerous legal and regulatory obligations, which may limit the right to erasure of your personal data.
    The right to erasure does not apply when processing is necessary for the following purposes:
    3.1. Exercising freedom of expression and information;
    3.2. Compliance with a legal obligation requiring processing applicable to DENTAL SCHOOL, TMCS, LDA;
    3.3. Reasons of public interest in the field of public health;
    3.4. Assertion, exercise, or defense of a right in a judicial process.

TAKING INTO ACCOUNT THE ABOVE, YOU WILL HAVE THE RIGHT TO REQUEST THE ERASURE OF YOUR PERSONAL DATA WHEN ONE OF THE FOLLOWING SITUATIONS OCCURS:

    The restriction of processing allows the client to request DENTAL SCHOOL, TMCS, LDA to limit access to personal data or suspend processing activities.

YOU MAY REQUEST RESTRICTION OF THE PROCESSING OF YOUR PERSONAL DATA IN THE FOLLOWING CASES:

4.1. If you contest the accuracy of your personal data, for a period of time that allows DENTAL SCHOOL, TMCS, LDA to verify its accuracy;
